Power of attorney

A Lasting Power of Attorney is a document which can be prepared by you to cover the situation in the future where you may lose, or begin to lose, your mental capacity so that you become incapable of dealing with your own financial affairs or health and welfare issues. A Lasting Power of Attorney gives you the opportunity to select, whilst you are still able to do so, those people that you would wish to take care of your affairs for you in those circumstances.

There are two types of Lasting Powers of Attorney:-

Property and Financial Affairs Lasting Power of Attorney

This document allows you to choose people to act on your behalf (as an attorney) and make decisions about your property and financial affairs whilst you still have capacity as well as when you lack capacity. For example, it may be easier for you to give someone the power to carry out tasks such as paying your bills or collecting your benefits or other income.

Health and Welfare Lasting Powers of Attorney

This document allows you to choose people to act on your behalf (as an attorney) and make decisions about your health and personal welfare when you do not have the capacity to do so yourself. This can include decisions about your healthcare and medical treatment, decisions about where you live and day-to-day decisions about your personal welfare, such as your diet, dress or daily routine.

Burton & Co can prepare the Lasting Power of Attorney document for you and arrange for it to be registered at the Office of the Public Guardian, which is necessary for your Attorneys to begin acting upon it.

Wills and probate

This may include obtaining valuations of the assets, preparing Inheritance Tax accounts, cashing in or transferring the assets in the estate, paying debts and distributing the estate.
